If content removal failed, what other options do you have?
Content removal may be requested for a number of different reasons by businesses and individuals, however unfortunately successful content removal can’t be guaranteed. There are numerous reasons as to why a URL may not be removed, and it is important you are aware of other options you have.
Why do people want to remove content?
It is quite common for people to search for how to remove negative content from Google search, how to remove a website from Google search results and how to suppress Google search results. It is also common for someone to request the removal of social media accounts and news articles. There are many reasons why an individual or business may want to remove content from the internet. It may be that the content is considered illegal, meaning that it violates principles of privacy, copyright or defamation law. Defamation is a common reason for content removal, with requirements being that the content is untrue, published and damaging to the person’s reputation.
It is common for businesses to approach Internet Removals in order to remove content that is defamatory; many businesses experience untrue and unfair reviews, many of which are left by fake accounts and competitors. For individuals, it is common for content removal requests to relate to images and videos of the individual, constituting breaches of privacy and often copyright. It is also possible for individuals to seek content removal where content is defamatory.
In what situation would a URL not be removed?
At Internet Removals, we petition on your behalf to third parties who host the content you seek to remove; as such, it is completely at the discretion of the third-party host as to whether or not they will remove the content. A URL may not be removed simply because it doesn’t constitute illegal content. For example, a restaurant review stating that the food tasted poor may be unfavourable, but that doesn’t mean that it is defamatory.
Human factors are also a large reason to why a URL may not be removed. For example, one person working with the third-party host platform may receive the content removal request and interpret it differently than the person sitting beside them. An example of this occurs with Google content removal; one person may read a review and believe it constitutes defamation, while another may feel it is not defamatory. Unfortunately, it is difficult when there is no control over the third party and when third parties may choose to ignore legal principles that relate to the content removal request. Internet Removals has specific methodology that involves repeatedly petitioning for the client in order to try and reduce these human factors and promote content removal.
What are the alternatives once content removal is unsuccessful?
If you find that you have not had success with content removal on a host platform, you may be able to escalate the matter. It is important to seek legal advice, as the next step would involve issuing legal documentation, such as a concerns notice. Internet Removals is able to refer clients to IRG Law where they can get legal advice and be assisted through the litigation process.
